TTTM – Ambassador & Influencer Cooperation Terms (T&C)
Welcome to the team! We are thrilled to have you as part of our community. This agreement governs the cooperation between Ticket to the Moon (TTTM) and you as an Ambassador/Creator.
To ensure a fair and professional partnership, the following terms and conditions apply:
1. Object of the Agreement and Product Provision
TTTM provides selected products to the Ambassador free of charge. These products are provided exclusively for the purpose of creating promotional content and actively promoting the personal discount code on the agreed social media channels.
The provided products are not intended for commercial resale, exchange for profit, or distribution through third-party marketplaces, unless TTTM has given prior written approval.
2. Ambassador Obligations
The Ambassador agrees to the following:
- Authentic Presentation: Creating high-quality image or video material (e.g., Reels, Stories, Posts) showing the products in an outdoor/lifestyle environment.
- Frequency: Unless otherwise agreed, the first content should be published within 30 days of receiving the products.
- Disclosure Requirements: All promotional content must be clearly labeled as "Ad" or "Advertisement" in accordance with applicable legal guidelines.
Critical Clause: Non-fulfillment & Clawback (6 Months)
The free provision of products is subject to the condition of a promotional consideration. If no agreed consideration (in the form of publications or verifiable promotion of the discount code) has taken place within 6 months of receiving the products, TTTM reserves the following rights:
- Invoicing: TTTM is entitled to invoice the full official Suggested Retail Price (SRP) of the provided products at the time of shipment.
- Return of Goods: Alternatively, TTTM may demand the return of the products at the Ambassador's expense, provided they are in new and resalable condition.
Note: This regulation serves to prevent "freebie hunting" and to preserve resources for active and engaged creators.
3. Prohibited Distribution & Anti-Spam Policy
To protect the integrity of the TTTM brand, the following activities are strictly prohibited:
- Coupon & Deal Websites: Posting affiliate links or discount codes on coupon aggregator sites, cashback platforms, or deal forums (e.g., Reddit deal communities, SlickDeals) is forbidden.
- PPC Advertising: Bidding on "TTTM", "Ticket to the Moon" or variations thereof in search engine advertising (e.g., Google Ads) is strictly prohibited.
- "Reveal Code" Mechanisms: Using "click to reveal" or masking techniques to stimulate clicks is not permitted.
- Resale of Provided Products:
Products provided free of charge by TTTM may not be resold, offered for sale, exchanged for profit, or listed on third-party marketplaces or classified platforms, including but not limited to willhaben, eBay, Facebook Marketplace, Vinted, or similar platforms. This also applies after the content has been published, unless TTTM has given prior written approval. - Self-Buying: Commission will not be paid on products purchased by the Ambassador for themselves. The personal discount code is intended for the Ambassador's audience.
4. Usage Rights
The Ambassador grants TTTM a non-exclusive, worldwide, perpetual right to use the created material for marketing purposes (Social Media Reposts, Newsletter, Website). TTTM will credit the creator whenever possible.
5. Compensation & Payouts
The Ambassador receives a 10% commission on net sales generated through their personal code. Payouts are subject to the following conditions:
- Immediate Payout: An immediate payout upon request is only available for amounts exceeding € 500.
- Standard Payout Cycle: For all amounts below the € 500 threshold, payouts are generally processed by our accounting department on a semi-annual basis (every six months).
- Payment Methods: Payouts are issued via PayPal or bank transfer.
6. Term and Termination
The cooperation is established for an indefinite period and can be terminated by either party at any time with written notice. However, the following conditions apply:
- Outstanding Obligations: Termination of the cooperation does not release the Ambassador from outstanding obligations regarding products already received.
- Immediate Clawback: If the Ambassador terminates the cooperation before the agreed-upon content for a provided product has been published or before the 6-month period has elapsed without performance, the provisions of Section 3 (Non-fulfillment & Clawback) shall apply immediately. In this case, TTTM reserves the right to invoice the SRP or demand the return of the product.
- Code Deactivation: Upon termination, the personal discount code will be deactivated. Any remaining commission claims will be settled according to the payout cycles defined in Section 5.
